Terms & Conditions

These Terms and Conditions ("Terms") govern the use of services provided by Oku Atelier ("we", "us", "our", "the Studio"), operating from 18 Lorong Maarof, Bangsar, 59000 Kuala Lumpur, Malaysia. By engaging any of our services, you ("Client", "you") agree to be bound by these Terms.

By confirming a service engagement in writing, signing a letter of agreement, or making any payment to Oku Atelier, you agree to these Terms in full. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. These Terms are governed by the laws of Malaysia.

3. Service Description

Oku Atelier provides interior design consultancy services as described on our website and in written engagement letters. Services are available to clients based in or around Kuala Lumpur and the Klang Valley. Geographic availability outside this area is assessed on a case-by-case basis and subject to additional travel arrangements.

4. Engagement and Scope

Each engagement begins with a written confirmation of scope, timeline, and fee. Changes to scope after confirmation must be agreed upon in writing and may affect fees and timelines. The Studio reserves the right to decline projects at its discretion.

5. Payment Terms

Service fees are quoted in Malaysian Ringgit (MYR) and are due as follows:

Payment may be made by bank transfer to account details provided in the engagement letter. Fees do not include materials, furniture, contractor costs, or government taxes unless explicitly stated.

6. Revisions and Changes

Each service includes a specified number of revision rounds as detailed in the engagement letter. Additional revisions beyond those included will be charged at an agreed hourly rate. Scope changes requested by the client during a project phase may require a revised agreement.

8. Intellectual Property

All designs, drawings, visualisations, mood references, specifications, and other materials produced by Oku Atelier remain the intellectual property of the Studio until full payment has been received. Upon receipt of full payment, the Client receives a non-exclusive licence to use the deliverables for the specified project only.

The Studio retains the right to use completed project images and general design concepts for portfolio and promotional purposes, subject to the Client's prior written consent.

10. Contractors and Third Parties

Oku Atelier may recommend contractors, suppliers, or third-party services as part of a project. These recommendations are made in good faith. The Studio is not responsible for the work, conduct, or pricing of any third party engaged independently by the Client. Where the Studio coordinates contractors directly under the Gentle Build Support service, the contractual relationship remains between the Client and the contractor.

11. Limitation of Liability

The Studio's total liability to the Client for any claim arising from a service engagement shall not exceed the total fee paid for that engagement. The Studio shall not be liable for indirect, consequential, or incidental losses, including delays arising from circumstances beyond our reasonable control (including contractor disputes, material unavailability, or force majeure events).

12. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of an engagement. The Studio will not share project-specific images, plans, or client details without written consent.

13. Termination

Either party may terminate an engagement in writing with 14 days' notice. Fees due for work completed up to the date of termination remain payable. The Client retains deliverables produced up to termination, subject to payment of amounts due.

14. Dispute Resolution

Any disputes arising from these Terms or a service engagement shall first be addressed through written communication between the parties. If unresolved within 30 days, the matter may be referred to mediation in Kuala Lumpur. These Terms are governed by the laws of Malaysia, and the parties submit to the jurisdiction of the courts of Malaysia.

15. Changes to Terms

We may update these Terms from time to time. The version in effect at the time of your engagement applies to that engagement. Updated Terms are published on this page with a revised effective date.
